The shadow of those questionable deals and bad decisions now stretches all the way to Washington County. &lt;o:p&gt;&lt;/o:p&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;Perhaps our local leaders didn’t know the true extent of Cobb EMC’s problems when they signed on for Plant Washington. But now, after repeated court battles which have cost the co-op millions of dollars and &lt;i style="mso-bidi-font-style: normal;"&gt;forced the members to take THEIR co-op&lt;/i&gt; &lt;i style="mso-bidi-font-style: normal;"&gt;to court at their&lt;/i&gt; own &lt;i style="mso-bidi-font-style: normal;"&gt;personal expense&lt;/i&gt;, the writing is on the wall in big bold letters. &lt;o:p&gt;&lt;/o:p&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;Dwight Brown’s legal woes are not over. On July 7, Brown was re-indicted, and charged with additional crimes. In addition to the 31 original counts of racketeering, theft, and making false statements, Brown is now charged with four counts of intimidating witnesses. The District Attorney has not ruled out the possibility of more indictments against other people.&lt;o:p&gt;&lt;/o:p&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;The legal problems aren’t over for the Cobb EMC Board of Directors either. Judge Schuster has ordered the Board of Directors to appear in his courtroom on August 12. The ‘Marietta Daily Journal,” a respected newspaper in Cobb County owned by Ben Tarbutton III’s father-in-law, recently described the Cobb EMC Board of Directors as “unindicted co-conspirators.”&amp;nbsp;&amp;nbsp; &lt;o:p&gt;&lt;/o:p&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;Did our local leaders know about the dirty dealings at Cobb EMC? We hope not. &lt;o:p&gt;&lt;/o:p&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;We may have fallen in love with Cobb EMC and all the pretty promises it made to us together with Power4Georgians. Four other EMCs called off the engagement two years ago.&lt;o:p&gt;&lt;/o:p&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;&amp;nbsp;It’s not too late to call off this wedding. Some people will be disappointed. Feelings might be hurt. If we stop now, no one has to buy a bride’s maid dress they don’t like and will never wear again. There won’t be a mess to clean up after the raucous reception. A lot of money can be saved. &lt;o:p&gt;&lt;/o:p&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div class="MsoNormal" style="line-height: normal;"&gt;This engagement has run its course. that supports assertions by our EMC Board and Power4Georgians that the success of the Plant Washington project is based on an independent analysis. &lt;span style="mso-bidi-font-weight: bold;"&gt;&lt;span style="mso-spacerun: yes;"&gt;&amp;nbsp;&lt;/span&gt;“Power4Georgians Plant Washington Coal-Fired Power Plant: Too High a Price for Consumers,” &lt;/span&gt;&lt;span style="mso-spacerun: yes;"&gt;&amp;nbsp;&lt;/span&gt;released by Georgia Watch on June 22nd, is another independent analysis&lt;span style="mso-spacerun: yes;"&gt;&amp;nbsp; has a post out about the report issued by Georgia Watch concerning a careful analysis of rate increases for EMC members involved in Plant Washington. This is one of several well researched reports, in stark contrast to the fact that the Washington EMC Board Chair Frank Askew said recently that there are NO independent studies making the case in favor of the plant.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://cobbemcowners.blogspot.com/"&gt;Cobb EMC Owners Association&lt;/a&gt; members are working even harder now that elections will be held, and a new CEO must be hired. Judge Schuster has called the Cobb EMC Board of Directors on the carpet for their management of the co-op. Mercury, a neurotoxin which can cause birth defects and developmental problems, is also recognized as a carcinogen.&lt;br /&gt;&lt;br /&gt;Parents, grandparents, aunts and uncles, elected officials, physicians, health advocates, faith leaders, citizens who have lived their entire lives as next door neighbors to coal plants, and yes, environmental leaders, covered a long list of reasons for adopting, and enforcing, these standards. There were very few people who opposed them, and most were working for a company creating the toxic emissions.&lt;br /&gt;&lt;br /&gt;Chris Hobson of the Southern Company said in his testimony that he didn't know if EPA has the authority to regulate "HAZARDOUS air pollutants like mercury." Which raises the question: if Southern Company testifies that mercury and other emissions they generate are hazardous, shouldn't they be interested in protecting us from them?&lt;br /&gt;&lt;br /&gt;Americans have waited 21 years since stronger clean air standards were announced for consideration. My husband and I raised our daughter from birth to 21 years old in that time frame. She has lived her entire life with air that is dirtier than it has to be. Future plans include purchasing existing natural gas powered plants rather than building new facilities.&lt;br /&gt;&lt;br /&gt;The Southern Alliance for Clean Energy posted a sharp analysis of why Georgia Power is choosing a more progressive approach for their rate payers and shareholders, while asking why Dean Alford and Power4Georgians continue to insist that a new coal fire plant is the best use of EMC member dollars. Now, in an attempt to recoup some of the lost money it poured into the plant’s development, Santee  Cooper’s &lt;a href="https://www.santeecooper.com/portal/page/portal/santeecooper/aboutus/wp_sale"&gt;ad&lt;/a&gt; in Power Engineering magazine advertises the sale of the used coal plant parts and the land surrounding the project.&lt;br /&gt;&lt;br /&gt;EMC members know that Power4Georgians’ EMCs have already wasted millions of our dollars on the  same outdated dirty coal technology that Santee Cooper abandoned. Yet our Board continues to pursue two coal fired power plants in rural Georgia. We wish we knew exactly how much of our money has been spent, but our EMC Board hasn't answered a single question we have asked during the last three EMC Annual Member Meetings.&lt;br /&gt;&lt;br /&gt;Santee Cooper realized that a dirty, expensive, coal plant is unnecessary for South Carolina. A court ruling had determined that. The Atlanta Journal Constitution (AJC) and the Marietta Daily Journal (MDJ) both reported last night that the Cobb EMC Board has decided that Brown must stay.&lt;br /&gt;&lt;br /&gt;The Marietta paper wrote, "In a prepared statement, Cobb EMC board Chairman Larry Chadwick said, "Nobody knows our co-op and the electric industry better than he does  and his expertise will help us continue meeting the objective of  supplying reliable and affordable power to our members."&lt;br /&gt;&lt;br /&gt;According to the MDJ, the settlement in a previous civil suit with Cobb EMC members required that Brown step down on February 28 and his employment not be continued. While EMC leaders wait for the judge to respond to their request, Brown will work as an independent consultant for the co-op.&lt;br /&gt;&lt;br /&gt;Board Chair Larry Chadwick was reported in the AJC to say that eight candidates were interviewed but none could match Brown's knowledge of the co-op or the industry.&lt;br /&gt;&lt;br /&gt;This decision by the Cobb EMC Board raises numerous questions, which include:&lt;br /&gt;&lt;br /&gt;&lt;ul&gt;&lt;li&gt;how did a co-op of this size become so invested in one employee that no one else can replace that person?&amp;nbsp;&amp;nbsp;&lt;/li&gt;&lt;/ul&gt;&lt;ul&gt;&lt;li&gt;if Brown is found guilty of any of the 31 counts of indictment what happens next for the co-op?&amp;nbsp; &amp;nbsp; &lt;/li&gt;&lt;/ul&gt;&lt;ul&gt;&lt;li&gt;&amp;nbsp;if the judge decides that Brown may not work for the co-op in any capacity, what will the next steps be?&amp;nbsp;&lt;/li&gt;&lt;/ul&gt;&lt;ul&gt;&lt;li&gt;if Brown is allowed to work for the co-op, what happens when Brown is no longer able to work (due to health issues or his desire to retire)&amp;nbsp; &amp;nbsp; &amp;nbsp; &lt;/li&gt;&lt;/ul&gt;&lt;ul&gt;&lt;li&gt;will the Cobb EMC Board ever abide by court rulings and operate within them rather than returning to court repeatedly?&lt;/li&gt;&lt;/ul&gt;&lt;div style="background-color: transparent; border: medium none; color: black; overflow: hidden; text-align: left; text-decoration: none;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="background-color: transparent; border: medium none; color: black; overflow: hidden; text-align: left; text-decoration: none;"&gt;The February 28 date for Brown's departure was determined long ago. Letters from the Rome and Augusta Chambers of Commerce were also considered by EPD staff to be part of, "approximately 1,000 comments against the measure....from a form letter on an environmentalist web site." The entire article is &lt;a href="http://www.ledger-enquirer.com/2011/02/09/1452192/dnr-board-not-told-of-letters.html"&gt;here&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;FACE contacted people who did submit comments, either by a letter they wrote themselves, or with a letter online. We value the time that was invested in doing that. In the future FACE will follow up with decision makers to make them aware of comments which have been sent.&lt;br /&gt;&lt;br /&gt;We appreciate that fact that DNR Board Chair Earl Barrs was interested in what was submitted, and would have welcomed an opportunity to be aware of the comments. According to testimony during the air permit appeals in September of this year, Cobb EMC has still not complied with earlier court rulings pertaining to operations, and has yet to hold board elections as well. Today a Cobb County grand jury said that the practices of Cobb EMC's  leader merit indictments which could result in 20 years of prison time  for racketeering, and 10 years for the other charges.&lt;br /&gt;&lt;br /&gt;While companies across the United States have abandoned coal as a profitable and responsible way to produce electricity, Cobb EMC and Power 4 Georgians have clung to outdated coal technology as the "best" solution for these five EMCS. In the second sound bite he said that the EPD is not sufficiently funded to cover enforcement of the regulations. He never mentioned the positive impact that cleaner air will have on citizens' health or our natural resoruces.&lt;br /&gt;&lt;br /&gt;At an EPD question and answer session over a year ago citizens asked how the EPD will monitor the coal ash waste and emissions from Plant Washington. At one point Capp said that they will stay on top of these issues, but he then said that because the EPD is underfunded and understaffed, that the public should call their offices if we see ash blowing in the area. It seems that the public is responsible for monitoring the toxin wastes and emissions in our neighborhoods.&lt;br /&gt;&lt;br /&gt;Today's news coverage shows that the Air Protection Branch of the EPD is more concerned about protecting the profits of energy producers in Georgia rather than the health of citizens and our natural resources. She ruled in our favor concerning particulate matter, carbon monoxide, and Maximum Available Control Technology (MACT). Along with our partners we are really pleased that after careful consideration Judge Walker has issued a ruling which reflects our concerns about the impact coal fired Plant Washington would have on our air quality.&lt;br /&gt;&lt;br /&gt;FACE is most appreciative of the many hours that our partners and attorneys have invested in this work. I was on the agenda and discussed the similarities between the concern over county's household garbage landfill and the dangers of a coal ash landfill with much more dangerous toxins.&lt;br /&gt;&lt;br /&gt;Additionally I discussed the limit on future jobs that the plant will create via degraded air and water quality. The lack of permits and enticement of jobs in the distant future were also part of my comments. I urged the commissioners to not put the cart so far in front of the horse by approving the road request.&lt;br /&gt;&amp;nbsp; &lt;br /&gt;Another point I made was that the county, and the county attorney, refused to accept the information concerning landfill privatization which citizens had presented to them in the last few weeks when the possibility of selling our landfill was announced. I think it is fair to say I chastised them about refusing to acknowledge the due diligence local citizens have done to be better informed about issues. I managed to make the Commission Chair Tommy Walker so mad he said he is glad this is his last meeting (he was defeated in the primary by returning chair Horace Daniel). I concluded by giving them 435 signatures of people who opposed the road re-routing, the issuance of water permits, and the plant in general.&lt;br /&gt;&lt;br /&gt;Dean Alford followed me on the agenda and explained that construction traffic coming south on Hwy 15 will turn and go east on Hwy 102, then south on Sparta Davisboro Rd.  Coming from the south toward the site traffic will go east on the Fall Line Hwy, turn and go north on Sparta Davisboro Rd. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Melton Jones made a motion to accept, Larry Mathis seconded, and approval was &lt;br /&gt;unanimous.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;During the public comment period after the items on the agenda were completed, Lyle Lansdell made several points about the health impact and her career experience in health outcomes related to toxins. She then discussed the new jobs being created via EE and conservation, and suggested that &lt;br /&gt;the tech school should focus on that type of training rather than the power plant.&lt;br /&gt;&lt;br /&gt;Lyle also raised the increased rail car traffic and pollution resulting from coal dust from the rail cars, and the highly populated areas where the rail traffic will be.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Pat Daniel spoke well about her family's decision to leave Atlanta decades ago because they preferred raising their family in a rural setting. The investments her family has in their land and homes is considerable. She told a story about a real estate deal falling apart here due to the plant. She &lt;br /&gt;also said that the plant will make our county a "cesspool" of waste. This will give you an idea of where it is:&amp;nbsp;&lt;a href="http://www.accg.org/county_db_detail_map.asp?u_input=Glascock"&gt;Glascock County &lt;/a&gt;  The county lives in the shadow of its neighbors, and is know for being  very conservative and having very little racial diversity (86.5% white  from 2009 data&amp;nbsp; &lt;a href="http://censtats.census.gov/cgi-bin/usac/usatable.pl?State=&amp;amp;County=13125&amp;amp;TableID=AAA"&gt;Glascock County data&lt;/a&gt;).&lt;br /&gt;&lt;br /&gt;The  tiny town of Gibson held its annual Winterfest and parade Saturday, December4. Dianna  Wedincamp with Ogeechee Riverkeeper, my husband David, and I set up a  display about the river and the proposed coal fired power plant and  hoped for the best. We were surprised with the great response we got  from people of all ages.&lt;br /&gt;&lt;a name='more'&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;Very few people said they  weren't interested, and many people wanted to learn more, share our  flyers with their friends, and sign comments opposing water permits for  Plant Washington (find out more here:&amp;nbsp;&lt;a href="http://www.google.com/support/blogger/bin/answer.py?answer=55373&amp;amp;cbid=-1u3fux70mwaec&amp;amp;src=cb&amp;amp;lev=%20topic"&gt; FACE &lt;/a&gt;&lt;a href="http://faceenvironment.org/"&gt;http://faceenvironment.org/&lt;/a&gt;).  We met men and women who are county leaders who not only signed  comments opposing the plant, but brought friends and family to our booth  to sign too.&lt;br /&gt;&lt;br /&gt;The only person who approached us who  supports the plant is county commission chair Anthony Griswell. After  challenging him on every point in support of the plant, he finally gave  us some suggestions on how we might shape our arguments to make stronger  points. We didn't change his mind, but we stood our ground.&lt;br /&gt;&lt;br /&gt;Tabling in Gibson was much better than we expected. It was encouraging to talk with  people who know we must protect our water and air. I had sold Glascock  short on having community members who are forward thinking and willing  to speak up for what they think is best. We were especially pleased to have new supporters from Jones and Wilkinson Counties, along with new folks from Washington County. Due to considerable work by FACE members we were able to submit 400 names in oppostion to the plant. &lt;br /&gt;&lt;br /&gt;Having hard working partners helped make tonight a success. We had new voices thanks to Ogeechee Riverkeeper staff and volunteers. The Georgia Chapter of the Sierra Club submitted 600 comments. A native West Virginian, Amelia Shenstone of SACE, was able to refute the comments in support of coal as a plentiful and easy to access fuel supply. Midge Sweet spoke on behalf of all Georgians for Smart Energy partners and set the tone for comments based on water depletion, water pollution, interbasin transfer issues, and the need to realistically assess water demand and planning.&lt;br /&gt;&lt;br /&gt;Please check back here for more information on both water and air permits.
